TITLE IX
"No
person in the United States shall, on the basis of sex, be excluded
from participation in, be denied the benefits of, or be subject to
discrimination under any educational program or activity receiving Federal financial assistance."
-Title IX of the Educational Amendments of 1972 to the 1964 Civil Rights Act"
-Title IX of the Educational Amendments of 1972 to the 1964 Civil Rights Act"
"Title
IX is a section of the federal law under the Higher Education Act that
prohibits sex discrimination in educational institutions. Many people
have known it as a law requiring equal male-female representation in
sports teams at U.S. colleges and universities, but it actually demands gender equity in all areas of colleges and universities that receive federal assistance." [Bolding added]

Title IX
"The U.S. Department of Education’s Office for Civil Rights (OCR)
enforces, among other statutes, Title IX of the Education Amendments of
1972. Title IX protects people from discrimination based on sex in
education programs or activities that receive Federal financial
assistance. Title IX states that:
No
person in the United States shall, on the basis of sex, be excluded
from participation in, be denied the benefits of, or be subjected to
discrimination under any education program or activity receiving Federal
financial assistance.
Scope of Title IX
Title
IX applies to institutions that receive federal financial assistance
from ED, including state and local educational agencies. These agencies
include approximately 16,500 local school districts, 7,000 post
secondary institutions, as well as charter schools, for-profit schools,
libraries, and museums. Also included are vocational rehabilitation
agencies and education agencies of 50 states, the District of Columbia,
and territories and possessions of the United States. (Bolding added)
Educational
programs and activities that receive ED funds must operate in a
nondiscriminatory manner. Some key issue areas in which recipients have
Title IX obligations are: recruitment, admissions, and counseling;
financial assistance; athletics; sex-based harassment; treatment of
pregnant and parenting students; discipline; single-sex education; and
employment. Also, a recipient may not retaliate against any person for
opposing an unlawful educational practice or policy, or made charges,
testified or participated in any complaint action under Title IX. For a
recipient to retaliate in any way is considered a violation of Title IX.
The ED Title IX regulations
(Volume 34, Code of Federal Regulations, Part 106) provide additional
information about the forms of discrimination prohibited by Title IX."
REQUESTING A WAIVER?
HAVE ANY HIGHER EDUCATION INSTITUTIONS, AS WELL AS ANY K-12 CATHOLIC SCHOOLS, WHICH HAVE ACCEPTED TITLE IX FUNDING REQUESTED A WAIVER FROM TITLE IX? Inquiring parents might consider asking that question of their arch/diocese or of any Catholic college where their student plans to attend or is already attending.
"§ 106.12 Educational institutions controlled by religious organizations.
(a) Application. This
part does not apply to an educational institution which is controlled
by a religious organization to the extent application of this part would
not be consistent with the religious tenets of such organization.
(b) Exemption. An
educational institution which wishes to claim the exemption set forth
in paragraph (a) of this section, shall do so by submitting in writing
to the Assistant Secretary a statement by the highest ranking official
of the institution, identifying the provisions of this part which
conflict with a specific tenet of the religious organization."
WHAT DOES TITLE IX SAY ABOUT TRANSGENDER STUDENTS AND GENDER IDENTITY?
"The
U. S. Department of Education has issued guidelines clarifying the
federal government's position regarding Title IX and transgender
students. Through these guidelines, the Department asserts that Title
IX's prohibition against sex-based discrimination extends to claims of
discrimination based on gender identity. In other words, the
Department's position is that Title IX applies to transgender students
and protects them for sex-based discrimination."
" President Obama’s edict requiring all public schools to open girls’ bathrooms, showers and other facilities to males who self-identify as female will lead to sexual chaos and confusion among children, critics predict.
Few media outlets are reporting the extent of the policy as described in the president’s new “guidelines”
but once people find out there is likely to be backlash, says the
author of a book critical of the theories of the late sexologist Alfred
Kinsey and the Kinsey Institute, which have largely been adopted by
public school sex-ed classes taught since the 1970s.
Dr. Judith Reisman, author of “Sexual Sabotage,” says the transgender agenda being pushed by the Obama administration is all coming down from the Kinsey Institute."
What about Housing and Roommate assignments in College dorms? Will the anatomy of your student's roommate match that of your student, or will the roommate's anatomy be the opposite of that of you student, aligning with gender identity instead?

"The
College of the Holy Cross, a Jesuit, Catholic institution in Worcester,
Mass., will implement a new housing policy in the 2016-2017 academic
year that embraces gender ideology, which Pope Francis has called
“demonic” and a threat to the family.
Holy
Cross says its housing of students on the basis of gender identity is
“required by applicable law,” and cites Title IX of the Educational
Amendments Act of 1972 in the policy section."
